1.1.Welcome to the website of the smileysteps.gr e-shop (hereinafter “E-shop”). The present e-shop, belongs to Papanastasiou L.George and is a continuation of the physical store of children’s shoes with the distinctive title “Smiley Steps Kids shoes” owned by him, founded in 2013 with headquarters in Halandri (14A Agios Georgios Street, P.C. 15234), with CEMI number 124432401000 and VAT number 038329505 (hereinafter referred to as the Company), contact phone 6977541698 or 2155504120 and email: info@smileysteps.gr. Our Company sells goods at a distance through its e-shop smileysteps.gr, respecting the provisions of N. 2251/1994, in conjunction with the provisions of N. 4242/2014 and other applicable legislation. Our company cooperates with branded children’s shoe brands in search of the best for our little friends.

1.2. The manager of the store is Papanastasiou Georgios.

1.3. Each user of our eshop before entering and browsing this website (indicatively: user registration, online ordering, “browsing”, product search, etc.), expressly and unconditionally declares that he/she accepts fully and completely the terms of use and operation of this eshop (hereinafter “terms”) and any other terms and policies that meet the requirements of the applicable law and may be found within this website, in addition to this text, such as for example the payment, return, shipping of products.

1.4 Acceptance of the terms is presumed by irrefutable presumption from the moment these terms are integrated within the e-shop in a prominent place and indicated by us to access and read them and facilitated by various means. The terms of this e-shop, which are predefined (general terms of transactions), are directly binding for the consumer, as long as they meet the legal requirements, i.e. their existence has been proven by our e-shop and the consumer has been provided with the opportunity to read, understand and study them and to gain substantial knowledge of their content (Art. 2, para. 1 of Law 2251/1994).

1.5. The registration of the user in the eshop constitutes automatic, explicit and unconditional acceptance of the terms of use and operation of our shop, and the transaction with our online store www.smileysteps.gr constitutes unconditional acceptance of the terms of transactions in their entirety. We advise you to carefully read the following terms of use and transaction conditions as well as all other aforementioned terms before you take any action, whether purchase, access, transaction or any other use of this website and to comply with them in their entirety.

1.6 Our Company reserves the right to modify at its free will, unilaterally and without notice, the current terms of use and operation of this e-shop. We hereby inform you that only by posting on this website, any new terms and conditions, or modification of old terms and conditions or cancellation of existing terms and conditions, will come into force, without prejudice to orders already processed or in progress by our Company.

1.7 Visitors/users have the obligation to check periodically, by visiting this e-shop, if there have been any amendments to these terms. Exclusively and only the posting of terms on this website and in any other place on this website fulfils the requirements of informing users of any changes to the terms. Any invalidity of any of the terms of use of this website shall not invalidate all the others.

1.8 In case of partial or total disagreement with the content of the terms of use of this website, we invite you to refrain from any action, access, transaction and general use of this website. Our Company reserves the right to modify, suspend, discontinue the operation of this e-shop and/or the services provided in it, such as for example for maintenance, updating or updating the website, etc., without any notice whatsoever, without prejudice to the rights of users and third parties under the law or their contract with our Company.

1.9. In particular, for a valid consumer contract with our online store www.smileysteps.gr, the 100% legal capacity of the persons contracting with us is required. This practically means that potential consumers of our products contract with us if they have reached the eighteenth (18th) year of age and are not in a deprivation of legal representation. Otherwise, the transaction is considered void as not having been made. If the transaction is cancelled for any reason whatsoever, the benefits already paid (shipment of goods – payment) shall be recovered in accordance with the provisions on unjust enrichment.

Consumers who use this e-shop accepting the terms and conditions governing it, are obliged, when entering into any form of contract, to provide us with accurate, complete and true data for the transaction with our store. Your transaction with our company is considered to have taken place exclusively at the moment you receive an “order confirmation” e-mail from us and is completed after the full payment of the order amount and the subsequent delivery of the products to the consumer. The contractors with our online store are obliged to provide a valid personal e-mail when ordering products.

1.11. Violation, in any way, of the terms of this, by the user-consumer shall entail penalties in accordance with the applicable legislation and the recovery of any damage of our company on the part of the user. The Company in case of violation of the terms of the present, may prohibit any user-consumer from accessing the website smileysteps.gr and all its services may delete his account, the history of his orders and all other data, without any notice whatsoever. The failure of the Company to exercise its statutory rights does not imply a waiver of these rights.

OBLIGATIONS OF USERS
2.1 In addition to the responsibility and obligations of users-consumers from this eshop, described above in the payment obligations, etc., users-consumers have the following obligations:

Users-consumers are obliged not to use the e-mail of this website, the product order forms and user registration forms, or any other means of this website or accounts of the eshop smileysteps. gr in social media (social media), such as Facebook, etc. for the posting, publication of information and data and other content that may be illegal, defamatory and / or false, threatening, fraudulent, extortion, abusive, abusive, pornographic and racist.

3.2. The Company does not modify, correct or interfere with data and information that the user provides in any way to the Company, without the prior notification – consent of the user. In the sales contract with our Company, the user’s use of the payment of the order made through the use of a credit card and the provision by the user of details of the legal holder of the credit card, binds the actual holder of the credit card, regardless of who has used this card or whether or not the actual holder was aware of it. Therefore, the consent of the rightful holder is clearly presumed, and we lawfully proceed to charge his credit card. The unlawful or unauthorized use of the credit card without the consent of the legal beneficiary thereof, does not release the beneficial owner of the transaction, from the obligations generated by this contract, nor from any claims of our Company for compensation from the anticontractual and unlawful action of the credit card user.

3.3. The registered members of our eshop www.smileysteps.gr are the ones who are solely responsible for the security and confidentiality of their codes and any damage caused to the Company, to them and any third party, by any unauthorized use of their codes by third parties or their disclosure to third parties.

3.4 For all of the above reasons, our users must keep confidential and not disclose to third parties their personal codes for accessing our eshop and log out of their account after completing their transactions or visits, especially when they have logged in from a third party’s computer or their personal computer is accessible to third parties. We request our members to keep us informed in case of any loss, unauthorized access, interception and/or unlawful use of their passwords by a third party not authorized by them, so that we can proceed to recover/change their passwords and protect them and their personal data.

3.5. Our Company is not liable to compensate the user if he/she violates the terms of use and operation of this eshop, makes untrue, inaccurate and incomplete provision of the requested and non-requested information and data, develops illegal activity within this website, violates the rules of proper use of the users, and does not fulfill the legal and / or contractual obligations he/she has undertaken. The user expressly accepts and acknowledges the discharge, of the Company in accordance with the above and accepts that he/she is fully responsible for his/her actions and the consequent obligations to compensate the injured parties.

Our Company is not liable for shortages in the availability of products nor for any temporary or indefinite inability to provide its services and for delays in the confirmation-acceptance and execution of orders and delivery of ordered products due to reasons of force majeure, due to weather phenomena, or fire, or due to strikes of suppliers, malfunctions of partner courier companies, malfunctions of the Internet Payment Processing Provider (Bank), illegal behaviour of third parties and for reasons beyond the Company’s control. Our Company is obliged to deliver to its customers the ordered products without actual defects.

3.6 Our Company shall not be liable for poor condition of the products delivered by it, provided that this is not due to incorrect storage of the products by our Company and provided that all preventive measures that our Company ought to have taken have been taken. The Company’s liability in the case of a defective product is limited to the obligation to replace it, provided that the legal requirements are met and the terms of the Company’s Returns-Replacement Policy are observed.

3.8. Our Company carefully controls the information provided to its consumers in accordance with the requirements of the law. In the event that our visitors perceive any incorrect information (e.g. unusually high or low price of a product), we advise them, before placing an order, to contact us at tel 6977541698 or email: info@smileysteps.gr for the immediate correction of the error, the provision of clarifications regarding the price and characteristics of the product and the more effective provision of our services to the consumer. The Company reserves the right not to execute an order, even if it is confirmed, if the characteristics (properties, price) of the products included in the order do not correspond to the reality and the price lists of our Company, i.e. it is a case of incorrect registration.

3.9 It is expressly forbidden to consumers and ordinary users of our e-shop to interfere with the content, operation, form, services, databases and any element that constitutes this e-shop, by using any malicious or non-malicious software, electronic or non-electronic means, sending infected files capable of infecting, destroying, damaging, suspending and generally impeding the smooth operation of this eshop and the use or access by visitors to this website. The Company reserves the right to request not only the rectification of any damage but also compensation for all illegal actions, such as those described above, as well as the prosecution of the person actually responsible.

3.10. Our Company shall not be liable for any damage to the user or the trader or any third party that may be caused by the delivery of the ordered products-goods by the partner courier companies (courier ELTA TEXHANS etc.) to a third party other than the actual one, if this person resides or works or stays at the user’s home or premises or any other place indicated by the user as the place of delivery of the products ordered and the user accepts to bear the relevant responsibility exclusively.

Transfer of risk: In contracts in which we ship the goods ordered to the consumer, the risk of loss or damage to the goods is transferred to the consumer when the company has already delivered the user’s order to the courier, and the courier has been authorised by the consumer to transport the goods, without prejudice to the consumer-user’s rights against the courier.

3.11.For any dispute arising from transactions of eshop www.smileysteps.gr with consumers, the applicable law is the law of the Greek state including the rules of International Law and European Legislation. For the resolution of disputes arising from contracts for the supply of our Company’s products to consumers, the Greek Courts are competent and the Courts of Elefsina or Athens are locally competent.

The above possibility of out-of-court dispute resolution is provided to consumers residing in the European Union, both for domestic and cross-border transactions. INTELLECTUAL PROPERTY PROTECTION AND RELATED MATTERS
4.1. Our Company smileysteps.gr maintains in its entirety the Intellectual Property of this eshop and all its individual web pages of which it is composed, which are protected in an absolute manner and independently as original works of visual design and arts, according to the conditions of the law and as collections of works (Law 2121/1993).

The web pages of this eshop are also protected as databases, since they bear all the characteristics of a database.

4.2. The distinctive features (from their use or their establishment in the market) as well as the entire content of eshop smileysteps.gr, are protected in accordance with the provisions of the law on unfair competition. The domain name smileysteps.gr has been legally registered with the National Telecommunications and Postal Commission (EETT) and granted to our Company, which has, among other things, the exclusive right to use it. In addition, our Company prohibits any third party from registering an identical or similar domain name to the one already assigned on the basis of the domain name assignment decision and the Law.

4.3 The lawful browsing of our Company’s eshop and its individual pages and the use of the services offered, with respect and full compliance with the terms of use and the conditions of operation as well as the applicable legislation, does not infringe the Company’s Intellectual Property Rights neither in the external elements of the website nor in its content.

PROTECTION OF PERSONAL DATA
5.1 The protection of consumers’ Personal Data is a priority of our Company. The management and protection of personal data is governed in its entirety by the terms of this contract and the relevant legislative provisions of Greek and Community law on the protection of the rights of individuals with regard to the processing of personal data, as well as the Decisions of the Personal Data Protection Authority (PDPPA), which we fully respect and comply with. Any legislative changes in the future will be subject to this contract. In order to provide you with the best possible services and products and to facilitate your purchases, we collect personal data only with your explicit consent and after you have been fully informed of your rights, as provided for in the provisions of Regulation 679/2016 GDPR and the interpretative Greek Law on the protection of personal data. Personal data (simple and sensitive), in accordance with Article 4 para. 1 of the EU Regulation 679/2016 EU on the protection of personal data, is: any information relating to an identified or identifiable natural person (“data subject”); an identifiable natural person is one whose identity can be verified, directly or indirectly. Simple personal data are all non-sensitive data. The processing of personal data of consumer-users is any operation which consists, inter alia, of collecting, recording, organising, structuring, storing, adapting or altering, retrieving, erasing, deleting, searching for information, using, communicating by transmission, disseminating or otherwise making available. Our Company takes appropriate technical and organizational measures to ensure the security and protection of user data from any accidental or intentional destruction, loss, alteration, disclosure or access and any other form of unlawful processing.

5.4 The Company, acting on the basis of the principle of legality, objectivity, accuracy, transparency, integrity and confidentiality, purpose limitation, minimization and limitation of the storage period, processes user data, which it acquires in a lawful manner and keeps on file, respecting the requirements of the law. 5.6 Unique, cases in accordance with the law (Art:

5.10. The credit card details are not stored by our Company during the transaction, but are stored directly in a secure environment of the partner bank Piraeus Bank, which is responsible for the routing of the cards.

5.11. In particular, we do not engage in unfair commercial practices, respecting the applicable laws of the country, always acting professionally, following the codes of good use and transactions that bind our commercial activity in order to provide excellent service to our consumers through our services. We provide the user with all the necessary information about our products, full and complete information about his rights as a consumer and comprehensive information about the general and specific terms of transactions, the right of withdrawal, in order to decide whether to contract with our online store.

7.2. The visitors/customers of the e-shop smileysteps.gr accept to receive messages free of charge with advertising content and messages of offers, competitions and discounts of the e-shop, after subscribing to the Newsletter of our company or after a transaction with our e-shop, and the possibility to object, in an easy way and free of charge, if they wish.

7.3 The conditions governing the sending of our Company’s newsletter are as follows:

a) smileysteps.gr sends periodically newsletters to its customers if they have subscribed to its services and have voluntarily provided their personal data and their consent for their processing and is not responsible if the newsletters are not delivered to their destination, although it makes every effort with the ISP’s (Internet Service providers) for the delivery
b) Newsletters may end up in the spam folder, so please users should regularly check that they are not stored there

c) We kindly ask users to add smileysteps.gr info@smileysteps.gr to their safe list

d) In case our users/customers wish to no longer receive newletters or wish to unsubscribe from the smileysteps.gr newsletter system altogether, they can inform us by using the Unsubscribe Newsletter.

e) smileysteps.gr uses a 3rd party company for the identification (tracking) of newsletter recipients. It does not deliver to 3rd parties information about name, surname, last name, home address

f) The information from smileysteps.gr , is only provided if our users choose it and for as long as they wish. On the contrary, if they have placed an order on smileysteps.gr, using our site, we send automated emails about the progress of their order. There is no way to deactivate these updates, the sending of which is a prerequisite for the correct progress of the order. We invite our users to keep these e-mails throughout the duration of our transaction. It is the users’ obligation, in the event that they do not receive the relevant e-mails, in accordance with the general conditions governing our transactions, to inform our Company without delay.

CUSTOMS CHARGES AND POLICIES
8.1 Our online store offers products within Greece. We may ship products on request to countries within the European Union. The consumer must be informed of any customs charges that may arise when ordering our products and requesting shipment to a Third Country (outside the EEA). The consumer must be informed of the necessary product specifications by the competent authorities of the country of delivery of the products. In particular, the products must meet certain customs requirements in order to be imported into the country of destination, such as weight, dimensions, accompanying documents, etc. The consumer is obliged to confirm that the products ordered meet these requirements.

If the consumer finds that the products he wishes to order do not meet the necessary conditions for importation into the country of destination, he must not place the order, otherwise he will be liable for any related costs incurred (costs of receipt, return, storage of the product, etc.).

The Consumer Code of Conduct for E-Commerce as formulated on the basis of the Ministerial Decision of the Minister of Economy and Development published in the Official Gazette of the Hellenic Republic (22/03/2017, No. 969).

TRANSACTION CONFIDENTIALITY AND SECURITY
10.1 The observance of confidentiality is taken for granted. The same basic principles that govern traditional transactions apply to e-commerce. GENERAL PROVISIONS
11.1 These terms and conditions apply personally to the user of this website. You will not be entitled to assign these terms, in whole or in part, to any third party without our prior written consent.

11.2 These Terms represent the entire agreement between us and you and supersede all and any prior terms, conditions, agreements and arrangements regarding your use of the www.smileysteps.gr Services.

11.3 We will act promptly if there is evidence that a User is in breach of these Terms. In the event that you know or suspect that illegal activities of any kind are taking place, or you know or suspect that works belonging to you, or your rights, have been infringed, please write to us at info@smileysteps.gr, and mark your letter as being for the attention of our “Legal Counsel”.

11.4 Any failure, by our Company, to enforce any of these terms shall not constitute a waiver of them or of our Company’s right to enforce any of these terms at a later date. Any persons who are not parties to these terms will have no right to enforce any provision of these terms.

11.5 Regardless of the country from which you access or use the www.smileysteps.gr Services, to the extent permitted by law, these Terms and your use of the www.smileysteps.gr Services shall be governed by the laws of Greece and you shall be deemed to have submitted to the exclusive jurisdiction of the courts of Athens, Greece, for the resolution of any disputes that may arise hereunder.
